As a parent concerned about all aspects of student data collection and student data sharing I would like to request the following list. If you cannot provide me with this information at the district level, please direct me to the correct person in my district who can.
These are my children and the state mandates that schools collect and share data on my children without my consent. It is my constitutional and parental right to know what data has been collected and what is done with my children's data AT NO COST to me. If you intend to bill me for this information whatsoever, please notify me in writing immediately, prior to any fee incurred. By law you must provide these to me.
The Family Educational Rights and Privacy Act (FERPA ) requires schools to provide parents access to their children's educational records:
"Under FERPA, a school must provide a parent with an opportunity to inspect and review his or her child’s education records within 45 days following its receipt of a request. A school is required to provide a parent with copies of education records, or make other arrangements, if a failure to do so would effectively prevent the parent from obtaining access to the records."
Q. What are the responsibilities of state education agencies for providing parent or eligible students access to education records?
A. A state education agency must provide parents and eligible students with access to education records the agency maintains. Although these agencies are not required to establish a written policy, they are obligated to honor rights of access and to restrict disclosure of information except to authorized individuals. - Please provide to me a list of ALL vendors and agencies that have access now, or in the past, to ANY student data, whether to collect, transfer, share, evaluate, store, or utilize student data in any way. This vendor list should include vendors at the state and my local school district level.
- Please also provide the signed contract with each of these above vendors, including but not limited to their data handling, storage, transfer, sharing/redistributing, selling and security policy.
- Please provide a listing of what data has been collected for each of my children while enrolled in Colorado schools ( my children and their schools are listed below).
- Please also identify what data from each of my children has been shared or transferred and TO WHOM, WHEN, and for WHAT PURPOSE and if this was pii (STUDENT LEVEL DATA.)
- Please provide a list of all agencies and vendors (and their contact information) who have had access to my children's data at any time; this includes third party vendors and any vendor who has redistributed, shared or sold either of my children's data.
- Please inform me of any time(s) when my children's data has been breached, and what data was breached, whether that be at the state, district or vendor level, including breaches that may occur if data is sent unencrypted via email.
